Abstract
Bien que la gestion des risques par l’État et ses mandataires soit une entreprise théoriquement destinée à les endiguer, nous constatons que lorsqu’elle s’applique aux personnes marginalisées, cette gestion a souvent pour effet d’accroître ou de multiplier les risques encourus par ces citoyens. Cette situation porte atteinte aux droits fondamentaux des personnes marginalisées et accroît leur vulnérabilité aux risques. Nous postulons que des pratiques basées sur les droits de la personne – dans une perspective bottom up – pourraient faire contrepoids au droit et aux politiques sociales et sanitaires favorisant l’émergence de risques. Nous proposons ici un « processus de socialisation des droits de la personne » par lequel le statut citoyen est envisagé comme une rencontre entre l’individuel et le collectif, dans une démarche d’empowerment.
