Abstract
Este artigo estuda as manifestações educativas do período da Constituinte até a Lei de Diretrizes e Bases da Educação de 1996. A convocação de uma Constituinte soberana eleita sob voto popular pacificaria e abriria o ciclo da Nova República. Por sua vez, as disputas saíram dos porões da ditadura e da edição autocrática de ‘atos institucionais’ para as lutas no campo institucional na arena da Constituinte. Analisamos este período histórico e realizamos uma revisão de literatura e de documentos, destacando as disputas para a cultura educacional do Brasil. Se a Constituição de 1988, a despeito das forças conservadoras e de seus malogros, conseguiu vitórias importantes para a rede de proteção social e para a educação nos termos de um Estado de bem-estar social em plena hegemonia neoliberal em todo o mundo, por sua vez, a LDB de 1996 não conseguiu o mesmo êxito.
