Abstract
Viewed from an insurer’s perspective, the ultimate adoption of the Montreal Convention 1999, which includes the obligation under Article 50 of State Parties to ensure that their carriers acquire ‘adequate insurance’, made little difference to the rating and pricing of their products and the quantum of coverage they were prepared to provide. Their acceptance effectively challenged the view of those not familiar with the workings of the insurance industry that a new Convention without a passenger liability limit in the event of passenger death or injury would stress the insurance market’s financial ability to provide ‘adequate’ coverage and substantially increase an air carrier’s insurance premium. This concern was unfounded and indeed, at the time, the aviation insurance market was more focused on correcting the financial imbalance between an insufficient premium base and the losses sustained by the aviation insurance market which had remained consistent over the years prior to 1999.
