Abstract
Article 8 of the Montreal Convention 1999 follows the wording of Article 7 of the Montreal Additional Protocol No 4. The issuance of multiple air waybills (AWBs) or cargo receipts is relevant for the forwarder’s exercise of its rights of disposition for individual packages. The wording of Article 8 permits the issuance of multiple cargo receipts which correspond to the number of individual packages carried. Article 8 does not apply to the common occurrence of an air carrier that ‘splits’ a Master AWB consignment consisting of several House AWBs / packages and carried under the same Master AWB on different flights for operational reasons, whether due to space constraints, weight restrictions or any other reason. In circumstances of a split consignment, portions of the consignment will be transported at different times, with copies of the Master AWB and without the issuance of additional AWBs or cargo receipts.
