Abstract
Durant la décennie 2010-2020 j’ai été une actrice, en tant qu’adjointe du Défenseur des Droits (DDD) de la France en charge de la mission de lutte contre les discriminations, de la montée en puissance de la préoccupation pour le respect des droits fondamentaux et de la poursuite de l’exercice d’une pleine citoyenneté pour les personnes qui avancent en âge. Le débat autour de cette question a été conduit au plan national, européen et international, s’appuyant sur le cadre normatif existant à ces échelles et posant la double question de l’appropriation de ce corpus actuel de droits et de l’éventuelle nécessité d’élaborer une convention internationale spécifique aux personnes âgées. M’appuyant sur mon expérience au sein de deux autorités indépendantes (la Haute Autorité de lutte contre les Discriminations et pour l’Egalité (HALDE) et le DDD) j’apporte ici ma contribution à une fresque historique et dialectique, avec les avis de toutes les parties prenantes, débouchant sur le constat des efforts à fournir pour promouvoir et investir au mieux le corpus normatif déjà existant dans un contexte européen où le recours aux juridictions supranationales est possible.
