Abstract
La Nouvelle-Zélande et le Québec représentent, en matière d’accidents d’automobile, les deux plus anciens systèmes d’indemnisation sans égard à la responsabilité. La première partie de ce texte vise à comparer les indemnités et les services dispensés à leurs clientèles les plus importantes, les personnes gravement blessées. C’est ici que ces régimes démontrent le mieux leurs avantages par rapport au régime traditionnel de la responsabilité civile. Une seconde partie porte sur le point sensible de ces régimes : la compensation des pertes non pécuniaires. Le régime québécois s’en tire ici mieux que son homologue néo-zélandais, ce qui amène l’auteur à s’interroger sur les limites qu’il convient de fixer à un régime universel d’indemnisation.
