O objeto do artigo consiste na análise da autonomia e atribuição, a partir das atribuições dos conselheiros tutelares, da reserva legal para a criação de nova atribuição, bem como da inter-relação entre os Conselhos Tutelares e os demais Poderes do sistema de justiça. Os objetivos são o de identificar as decisões judiciais sobre autonomia e independência do Conselho Tutelar, quais foram as espécies normativas levadas à apreciação do poder judiciário e a posição jurisdicional. O método adotado foi indutivo, a partir de um caso concreto de Ribeirão Preto/SP e da pesquisa descritiva da jurisprudência e doutrina sobre o tema. Os resultados encontrados foram os de que a competência está expressamente prevista no Estatuto da Criança e Adolescente (art. 136), mas é comum que os demais atores busquem fixar normas que reduzam a autonomia e independência dos Conselhos.
