Abstract
Dans le cadre de cet article, nous analysons l’accès aux droits des femmes selon la dialectique luhmanienne d’inclusion et d’exclusion au sein des systèmes. À partir des résultats d’une étude ethnographique de 8 mois menée auprès de groupes de femmes au Nord Kivu (RDC) en 2011 et 2012, nous verrons en effet que la communauté locale joue un rôle déterminant sur les conditions d’inclusion des femmes au sein des autres systèmes sociaux. De plus, en tant que groupe historiquement marginalisé, les femmes se retrouvent «sous-intégrées» au sein des systèmes sociaux. Bien que n’ayant pas accès aux bénéfices des différents systèmes juridiques et normatifs, telle que la protection de leurs droits, les sous-intégrées doivent tout de même se soumettre aux devoirs et aux responsabilités imposées par les structures coercitives. Elles subissent aussi de manière disproportionnées leurs forces punitives. Par conséquent, les femmes doivent mettre en oeuvre des stratégies d’invisibilité à travers leur réseau, une structure qui échappe au monopole du système communautaire sur les individus, dans le but de satisfaire certains de leurs droits fondamentaux.
