Abstract
La loi dite « PACTE » a introduit trois évolutions majeures dans le droit des sociétés français, que l’on présente volontiers sous la forme évocatrice d’une fusée à trois étages. Le premier étage, qui concerne l’ensemble des sociétés du droit français et ne requiert de leur part aucune démarche particulière, a consisté à introduire dans la notion d’intérêt social du groupement les enjeux sociaux et environnementaux de son activité. Le deuxième étage de la fusée consiste en une « raison d’être », constituée de principes que la société introduit dans ses statuts et auxquels elle entend affecter des moyens. Enfin, le troisième étage de notre fusée est le statut de société à mission, qui voit les sociétés commerciales désormais en mesure d’identifier un ou plusieurs objectifs sociaux et environnementaux qu’elles envisagent de poursuivre dans le cadre de leur activité.
