Actuellement, de nouvelles perspectives pour des chaînes d’approvisionnement soutenables se dessinent au sein de l’Union européenne. Le 23 février 2022, la Commission européenne publiait une proposition de directive sur le devoir de vigilance des entreprises en matière de durabilité. Cette Proposition se situe dans la droite ligne de la loi française relative au devoir de vigilance des sociétés mères et des entreprises donneuses d’ordre adoptée en 2017. Mais elle comporte également quelques innovations notables par rapport à la loi française. Cette dernière prévoit un mécanisme à double détente, envisageant successivement prévention des risques et sanction des atteintes. Ici, des mesures d’aide et d’accompagnement des entreprises complètent des prévisions enrichies relatives à la prévention et la sanction, au sein d’un mécanisme à triple détente.
