Abstract
Il y a quelques années la mission est apparue dans le paysage juridique des entreprises comme un OVNI. Notion étrange et surprenante à l’époque, elle est venue en enrichir d’autres gravitant dans le monde du droit des sociétés. Le juriste commence aujourd’hui à mieux la circonscrire, même si certains mythes sont encore tenaces. L’OVNI est de mieux en mieux identifié. Si la mission est une notion qui existe sans le droit, elle est en effet aujourd’hui saisie par le droit. L’apparition d’une nouvelle forme d’entreprise en témoigne : l’entreprise à mission. Cette entreprise n’est pas une, elle peut être spécifique ou certifiée. Elle est finalement l’objet d’un foisonnement normatif ainsi qu’en témoigne le projet de loi n o 747 du Québec, mais présente un fil conducteur : démontrer une volonté de crédibiliser et d’asseoir les démarches éthiques et de responsabilité sociale des entreprises en s’appuyant sur une double mission sécurisée.
