Abstract
최근 승객이 항공사를 대상으로 청구하는 지연손해에 관한 책임 공방이 현재 전 세계 항공운송업계에서 상당한 논란을 불러 일으키고 있다. 특히, 지연으로 인해 발생한 운송인이 배상하여야 할 손해의 범위를 어떻게 설정해야 하는지, 금전적인 배상청구로 일괄하여 책정할 수 있는지, 관련 경제적 손실에 관한 무제한의 간접손해 또는 우발적 손해에 대한 적용 확대를 어느 정도로 제한해야 하는지, 재산상의 수치로 산출될 수 없는 정신적 손해도 그러한 지연손해의 범위에 포함시킬 수 있는지 등이 소송상의 관련 논점으로 제기되고 있다. 우리나라의 경우, 국민여가활동의 증대로 인해 항공여행이 폭발적으로 증가하고 있고, 동시에 이러한 운송 지연과 관련한 승객들의 배상청구소송들이 최근 잇따르고 있다. 지난 10월, ‘제주항공지연손해 배상사건’이라고도 불리는 대법원 2023. 10. 26. 선고 2021다259510 판결 역시 이러한 승객들의 적극적인 배상청구소송의 일환으로 볼 수 있는데, 대법원에서 몬트리올 협약상 지연손해에 관한 최종적인 입장을 제시함으로써 상당한 주목을 받은 바 있다. 이에 본 논문에서는 대법원의 상기 2021다259510 판결을 분석하여 몬트리올 협약상 운송인의 지연손해 책임에 관한 우리법상의 입장을 정리하여 관련 쟁점에 대한 몇 가지 시사를 도출해 보았다. 본 논문에서는 몬트리올 협약의 적용범위와 관련한 법리 및 각국의 판례법을 살펴보고, 이를 토대로 2021다259510 판결의 판시취지를 분석해 보았다. 결론에서는 몬트리올 협약상 운송인의 지연손해책임에 대해 본 판결이 어떠한 논의와 실익을 주는지 검토해 보았다.
