Abstract
Au prisme des droits humains européens, les autaires analysent les catégories sportives de « sexe » à travers la règlementation d’athlétisme de World Athletics et de l’affaire Caster Semenya. Les règlements les prévoyant sont-ils discriminatoires (article 14 CEDH)? Conduisent-ils à des actes de torture et à d’autres traitements inhumains et dégradants (article 3)? Violent-ils la vie privée (article 8)? Comment inclure les personnes intersexuées, transgenres, notamment non binaires, dans les compétitions internationales? Après avoir montré que la bicatégorisation telle qu’elle est imposée par le règlement de World Athletics est contraire aux droits humains, les autaires envisagent des modifications et des alternatives inspirées d’autres espaces sportifs.
