Abstract

Este artigo explora especificamente sobre o "incentivo e direcionamento à regionalização do saneamento", o eixo estruturante da regionalização do saneamento, em que os estados são incentivados a agrupar seus municípios em regiões, por meio de lei estadual. O tema não é recente no Brasil, tendo sido tratado na década de 1970 e também após o marco promulgado em 2007, sendo registradas iniciativas regionais/estaduais em diversas oportunidades e sob distintos arranjos, tendo em vista a escala (por exemplo, consórcios, contratos de programa) e a viabilidade da prestação (subsídios entre municípios e entre usuários – via prestadoras). Entretanto, embora a prestação dos serviços seja um dos objetivos da regionalização, o disposto na legislação de 2020 não deve ser confundido com a prestação regionalizada dos serviços, como se aborda adiante neste texto. Por isso, é oportuno o registro dos arranjos liderados pelos estados para o cumprimento da lei.
