Abstract
Les droits des personnes LGBT constituent au Japon un domaine extrêmement mouvant, difficile à prédire, tant sont variées les problématiques, les modalités d’action, ainsi que les sources d’inspiration voire de pression. Le cas japonais permet d’illustrer la complexité des mécanismes pluriels du politique et du judiciaire, en interaction convergente ou divergente, sur des thématiques tout aussi variées que l’orientation sexuelle ou l’identité de genre. Le présent article a pour objet les revendications pour le mariage entre personnes de même sexe qui, face aux solutions juridiques improvisées ou insuffisantes, se traduisent par des revendications judiciaires menant à la judiciarisation possible de la sphère politique.
