JUSTIÇA RESTAURATIVA: POSSIBILIDADES DE APLICAÇÃO NO BRASIL

Abstract
Objetiva-se neste artigo abordar o tema da Justiça Restaurativa, apresentando algumas possibilidades para a sua aplicação no Brasil, em convivência harmônica com a Justiça Retributiva. O conceito, os princípios e as modalidades de aplicação da Justiça Restaurativa são a base para a análise da sua utilização no Brasil. A partir de três casos concretos – um no município de São José dos Campos, outro no município de São Caetano do Sul e o terceiro em uma empresa privada – e de algumas decisões do Poder Judiciário brasileiro sobre casos conectados com a Justiça Restaurativa, são avaliadas as possibilidades de sua aplicação em maior escala no país, destacando as vantagens dessa aplicação e as áreas nas quais é mais indicada, assim como os obstáculos existentes.
