Cette recherche traite de l’organisation et de l’effectivité juridique de la liberté de manifestation au sein des ordres constitutionnels français, canadien et espagnol. Plus particulièrement, elle propose une étude des rapports qu’entretiennent les normes garantissant le droit de manifester et celles permettant de restreindre son exercice au sein de la hiérarchie des normes. Depuis le début des années 2000, le recours à la manifestation pour exprimer une opinion politique a gagné en légitimité, qui ne livre cependant aucune information relative à son existence juridique à son degré de protection. Parallèlement à la montée des contestations citoyennes, on observe partout dans le monde un accroissement des préoccupations sécuritaires. De cette manière, l’exercice de la liberté de manifestation se trouve confronté à un arsenal normatif permettant de contrôler et d’assurer l’ordre et la sécurité publics dans les espaces publics. Au regard de ces évolutions, il convient d'examiner les fondements du droit de manifester comme de ses limitations dans différents ordres juridiques choisis en raison des spécificités de leur réponse. On pourra ainsi se demander dans quelle mesure il s'agit d'un processus de restriction indéterminé au regard de laquelle ce droit apparaît plutôt comme une action politique plus ou moins tolérée par les pouvoirs publics que comme une liberté fondamentale rigoureusement garantie et soutenue à une jurisprudence cohérente et différenciée.
