Abstract
La Convention d’Aarhus fixe des obligations aux États Parties en termes de participation du public au processus décisionnel, ainsi que d’accès à l’information et à la justice, en matière environnementale. Ses principes se retrouvent dans le fonctionnement de la convention, délégués et ONG évoquant un « esprit d’Aarhus » pour en décrire les règles et pratiques de décision collective. À deux reprises, en 2017 et 2021, la délégation de l’Union européenne (UE) a remis en cause la pratique d’adoption par consensus des décisions de la Réunion des Parties au sujet d’une décision de non-conformité la concernant. En abordant les effets des normes sur le comportement des acteurs, il s’agit d’évaluer la portée de ces deux précédents à la fois pour l’UE et pour la convention. Une lecture pragmatiste des échanges entre acteurs combinée à une démarche d’ethnographie institutionnelle montre comment les pressions normatives exercées par les défenseurs de la convention ont finalement prévalu.
