Promesses technologiques et protection des intérêts personnels à l’ère des données massives : Comment trouver un juste milieu ? Les nouvelles technologies numériques ont connu d’importants avancements au cours des dernières années. Étant à l’aube de l’ère de l’intelligence artificielle, ces dernières ont créé une soif inédite pour les données de toutes sortes. Bien que ces technologies soient prometteuses de nombreuses améliorations à nos vies quotidiennes ainsi qu’à plusieurs domaines telle la médecine, le droit, et la pharmacologie, elles engendrent aussi de nombreuses préoccupations. Ainsi, il y a actuellement un effort en cours pour trouver des solutions qui sauront mieux encadrer ces nouvelles technologies et protéger les intérêts individuelles et collectifs, sans toutefois nuire à l’essor de leur plein potentiel. La fiducie de données fut identifiée comme une telle solution. Prônée pour sa versatilité et sa flexibilité, elle est présentée comme un outil qui permettrait de trouver un juste milieu entre innovation et protection des intérêts individuels dans le cadre d’une stratégie de gouvernance responsable des données. Plusieurs sont ainsi à étudier son applicabilité dans différents secteurs et différentes juridictions et elle est l’objet de la présente étude. Cette étude s’intéresse spécifiquement à savoir si une fiducie de données pourrait être établie au Québec pour la gestion des données dans le domaine de la santé.
