Abstract
Dans cet article, il s’agira de montrer que la jurisprudence donne à voir un processus d’élaboration collective des règles juridiques qui peut inspirer le projet d’une démocratie participative, voire d’une démocratie directe. La jurisprudence est en effet une institution dans laquelle les règles juridiques sont produites collectivement, non seulement par les juges, mais aussi sous l’influence et sous le contrôle des justiciables. Cette dimension participative de la jurisprudence connaît toutefois des limites. L’existence d’une hiérarchie judiciaire en constitue la principale. Mais il en existe d’autres, sur lesquelles cet article reviendra. Nous montrerons, cependant, que ces limites peuvent être surmontées et formulerons des propositions pour approfondir la dimension participative de la jurisprudence. Ultimement, cet article montrera que la discipline juridique peut apporter un éclairage nouveau sur les débats relatifs à la démocratie participative.
