ASSÉDIO SEXUAL NO TRABALHO: DESAFIOS NA PRODUÇÃO DE PROVAS PELAS VÍTIMAS.

Abstract
O presente artigo tem como tema central o crime de assédio sexual nas relações de trabalho, elencado no Código Penal brasileiro, no rol dos crimes contra a Dignidade Sexual, tipificado pelo artigo 216 – A. Este que consiste no ato de constranger alguém com o intuito de obter vantagem ou favorecimento sexual, prevalecendo-se o agente de sua condição de superior hierárquico ou ascendência inerentes ao exercício de emprego, cargo ou função. Conduta que sempre existiu em diversos contextos organizacionais, porém com pequena incidência de denúncias tendo em vista a necessidade de produção de provas. Esta que é elemento determinante no desfecho da ação penal. Assim, disciplina o artigo 156, CPP, que o ônus da prova é da acusação, que apresenta a imputação em juízo através da denúncia ou da queixa-crime. Neste sentido, considerando que esta hipótese de crime ocorre no seio dos ambientes de trabalho, na clandestinidade, as ocultas, raramente deixa vestígios, torna-se uma grande barreira para representação do acusado. Desse modo, no intuito de verificar os desafios das vítimas deste crime em produzir provas, a metodologia adotada utilizou-se da pesquisa bibliográfica e qualitativa, como método de análise o dedutivo e comparativo e na análise dos dados a observação direta intensiva. Neste contexto, pode inferir que diante das limitações da denúncia, por ausência de provas, uma considerável parcela das vítimas opta por se calar resultando na impunidade e na perpetuação de uma cultura de poderio associada à violência.
