S’appuyant sur une assimilation du droit international à un discours que les acteurs du champ juridique international utilisent pour justifier ou critiquer leurs positions respectives, cette étude se déploie en deux temps. Tout d’abord, on montre que l’interprétation extensive de la légitime défense avancée par la Russie, si elle n’est pas novatrice dans son principe, a, comme lors des précédents auxquels elle fait écho, été rejetée par la communauté internationale des États dans son ensemble. Ensuite, on souligne que, dans ce contexte, le droit dit de la « neutralité », forgé à la fin du 19e siècle, prend un sens particulier au regard de la Charte des Nations Unies. Dans un système où le recours à la force est à la fois strictement prohibé sur le fond et encadré par des organes de sécurité collective sur le plan procédural, les États tiers au conflit ont le droit d’assister l’Ukraine dans sa défense contre l’agression russe. Cela ne signifie pas que le principe de neutralité n’ait plus aucune portée. Outre qu’il caractérise encore le jus in bello, il trouve des déclinaisons en jus contra bellum, que ce soit pour caractériser l’usage de la force dans le cadre d’une guerre civile ou pour qualifier les missions d’opérations de maintien de la paix.
