Abstract
En Afrique du Sud, au Royaume-Uni Royaume-Uni, au Canada (Ontario), en Australie et en Nouvelle-Zélande, les tribunaux ont estimé que lorsqu’un salarié démissionne dans le feu de l’action, il convient de procéder à une évaluation objective pour déterminer si le salarié avait réellement l’intention de démissionner. Si un employeur considère que la relation de travail a pris fin alors que (d’un point de vue objectif) le salarié n’avait pas l’intention de démissionner, cela pourrait être considéré comme un licenciement. Cet article recommande aux tribunaux sud-africains de développer la Common Law en termes de droit constitutionnel à des pratiques de travail équitables, afin de reconnaître qu’une démission brutale, compte tenu des mots et du contexte, peut objectivement indiquer qu’un salarié n’avait pas l’intention de démissionner. Si l’employeur traite la « démission » comme ayant mis fin à la relation de travail dans ces circonstances, elle devrait être considérée comme un licenciement.
