Abstract
The first question in constitutional law is ‘what is one’s image of a constitution?’ This is the first question because what has hitherto been taken as an objective law really breaks down into one’s own image of a constitution. I shall show how this is so with respect to the ‘subject-matters’ of the ‘rule of law,’ ‘separation of powers,’ and the interpretation of section 96 of the Constitution Act, 1867 (formerly called the British North America Act). In this and in the following chapters in Part I , I aim to demonstrate that the first question in the law of a constitution is ‘what is one’s image of a constitution?’
