Abstract
Após a II Guerra Mundial, o termo judicialização foi cada vez mais associado à ampliação dos direitos fundamentais. No Brasil, a partir da Constituição de 1988, o Estado assume a responsabilidade de garantir a saúde da população, tornando-a um direito indispensável e, com isso, o acesso do cidadão às instâncias do Poder Judiciário também foi ampliado. Dessa forma, o presente artigo, trata-se de um estudo qualitativo, resultado de uma revisão de literatura narrativa e de um estudo de abordagem crítica acerca da legislação brasileira sobre o fenômeno analisado, bem como da análise dos dados da pesquisa da INTERFARMA. Os resultados mostram que a judicialização da saúde é um fenômeno cada vez mais frequente nos tribunais brasileiros, o que reflete na precariedade do trato administrativo na saúde pública. Pode-se concluir que a judicialização da saúde é um procedimento legítimo para que se garanta o direito fundamental à saúde, quando da sua negligência pelo Poder Executivo.
