SAÚDE BUCAL E POLÍTICAS DE PROTEÇÃO AO ALEITAMENTO MATERNO VERSUS SUAS FRAGILIDADES

Abstract
A experiência de muitas mulheres para conciliar a maternidade e o trabalho tem sido desafiadora, uma vez que a mulher, ao tornar-se mãe, acaba sendo obrigada a se adaptar a uma dupla jornada. Considerando que o aleitamento materno é uma prática essencial para a saúde da criança, essa realidade só deixa de causar desmame precoce quando há condições favoráveis à manutenção do aleitamento. O objetivo desse estudo é identificar potencialidades e fragilidades nos marcos políticos históricos que regulam os direitos das mulheres no que se refere a o aleitamento natural e a jornada dupla de trabalho no Brasil e reunir argumentos que justifiquem a necessidade de políticas públicas mais efetivas. Desse modo, foram analisados 5 marcos políticos que asseguram à lactante, em alguma medida, o direito de amamentar. O recorte temporal tem como marcos: Art.396e Art. 389 do Decreto de Lei nº 5.452, da CLT de 1943; Art. 7, inciso XVIII Constituição Federal de 1988; a Lei n° 11.770 - Programa Empresa Cidadã de 2008 e a Portaria Nº 193, Art. 1º nº 01/2010. Foram identificadas potencialidades e fragilidades no que se refere a cada lei de proteção ao aleitamento materno. Observa-se que, apesar dos avanços e conquistas significativas, existem fragilidades nos programa se Leis, pois não garantem respaldos suficientes a mulheres que trabalham e são mães, sendo necessário que as políticas públicas viabilizem maiores possibilidades à mãe no que tange a conciliar seu trabalho com o direito de amamentar.
