La procédure du recours collectif est un véhicule de plus en plus utilisé par les assurés afin de faire valoir leurs droits contre les assureurs. Ce phénomène s’explique notamment par les règlements faramineux conclus aux États-Unis et au Canada dans des litiges touchant certaines pratiques de commerce des assureurs et, plus particulièrement, dans les dossiers relatifs aux polices d’assurance vie entière avec participation et leur option d’autofinancement des primes (vanishing premiums). Cependant, on constate que les tribunaux nord-américains sont peu enclins à autoriser les recours collectifs contre les assureurs en raison principalement de la difficulté d’établir des questions de faits et de droit communes à l’ensemble du groupe lorsque le recours repose sur de fausses représentations.
