Abstract
Cet article se rapporte exclusivement à l’assurance maritime, sous l’angle des dispositions régissant ce type de contrat, en vertu des articles du Code civil du Quebec. Parmi les principes essentiels, il faut signaler que le contrat d’assurance maritime est un contrat d’indemnité. De plus, l’assuré doit posséder un intérêt d’assurance dans une opération maritime ou le bien assuré. Il doit aussi déclarer à l’assureur tous les faits et circonstances qu’il connait susceptibles d’influencer l’assureur dans l’appréciation du risque. II examine aussi les règles du contrat concernant le voyage, tout changement, déroutement ou retard et les conséquences pour l’assureur ou l’assuré. Cet article décrit aussi les types de contrat (au voyage ou de durée), la détermination des valeurs assurables, le contenu de la police, les droits et obligations des parties et de nombreuses autres règles (déclaration du sinistre, détermination de l’indemnité, cession, engagements, délaissement, espaces d’avaries, subrogation, cumul d’assurance, sous-assurance, assurance mutuelle, action directe).
