Abstract
Abordamos a participação dos legisladores na construção da ditadura civil-militar em seus anos iniciais (1964-1968), a partir do conceito de “juristas orgânicos”, que relaciona formulações específicas de Pierre Bourdieu e Antonio Gramsci. Analisamos a atuação jurídica de Miguel Reale a partir de dois documentos da sua autoria: o “Parecer” (de 12 de setembro de 1964) que orientava a cassação de funcionários públicos estáveis e o texto “Revolução e Normalidade Constitucional” (1966), que buscava uma legitimação jurídica da Ditadura, além de fundamentar a “revolução” como a transição jurídica entre a ordem deposta e a vigente, justificando o processo legiferante ditatorial. Concluímos que os “juristas orgânicos” foram fundamentais na construção da autocracia no País.
