El artículo pretende discutir críticamente las razones que moti­varon la declaratoria de exequibilidad, por parte de la Corte Constitucional de Colombia, de la norma que introdujo la imprescriptibilidad de los delitos contra la libertad, integridad y formación sexuales, o el delito de incesto, co­metidos en contra de personas menores de edad. Tal discusión tendrá como criterio de análisis los fundamentos generales de la figura de la prescripción de la acción penal, una caracterización del fenómeno denominado populismo punitivo en Colombia en relación con los delitos sexuales contra menores de edad, así como los mandatos del bloque de constitucionalidad.
