В статье исследуются правовая основа и практика применения консультативной юрисдикции теми международными судами, которые имеют на это соответствующие полномочия. Отмечается, что в отсутствие универсальных правил консультативной юрисдикции в международном правосудии суды различаются самым кардинальным образом как в части круга лиц, имеющих право обратиться в суд с соответствующим запросом, так и в отношении предметной компетенции, т.е. круга правовых норм, которые имеют право толковать суды. Современная практика консультативных заключений показывает, что они могут эффективно использоваться не только для целей толкования норм права, но и как инструмент для решения организационных проблем международных организаций, при которых они созданы, а также для минимизации недостатков юрисдикции того или иного суда в части разрешения споров. При этом в статье высказывается непопулярная в отечественной доктрине мысль о том, что Консультативные заключения международных судов могут не только вносить вклад в развитие международного права, но и порождать также целый ряд проблем, среди которых, в первую очередь, можно упомянуть попытки использовать консультативные заключения суда не для толкования абстрактных вопросов права, а для де-факто разрешения спора. В том, что касается вопросов возможного правового эффекта (значения) заключений, имеющих в силу своей природы необязательный характер, в статье высказывается тезис о том, что заключения имеют лишь силу убеждения (res interpretata), которая при этом не является постоянной величиной, одинаковой для всех судов, и варьируется от суда к суду и от заключения к заключению в зависимости от авторитета самого суда и от убедительности его аргументов. Несмотря на то, что практика Суда ЕАЭС в части консультативных заключений находится пока в стадии становления, все указанные в статье особенности и риски консультативной юрисдикции полностью применимы к Суду ЕАЭС.
