Abstract
Le droit de la filiation, cet insoumis * par Nicholas KASIRER ** Vous me faites honneur, ce matin, en m'invitant à prendre la parole pour lancer ces travaux importants sur la réforme du droit de la famille.J'en suis fort touché; mais un juge mérite-t-il toutes ces belles attentions?Je me permets de faire un constat bien simple et bien évident : c'est l'université et non la magistrature qui mène la réforme moderne du droit privé au Québec et, surtout, la réforme du droit de la famille qui fait l'objet de notre regard de ce matin.* Ce texte reprend celui d'une allocution d'ouverture prononcée dans le cadre du colloque « Réforme du droit de la famille : quelles filiations et quels droits pour les enfants d'aujourd'hui?», qui s'est tenu le 25 mai 2022 à la Faculté de droit de l'Université de Sherbrooke.Il en a conservé le style oral.** Juge à la Cour suprême du Canada.
