Este trabajo examina si la vigente Ley de Contratos del Sector Público corrigió o no, la insuficiencia de ka antigua Disposición Adicional Vigésimo Tercera del Texto Refundido de la Ley de Contratos del Sector Público, para prevenir la colusión entre oferentes en la contratación pública, toda vez que la antigua norma no otorgaba potestad a los órganos de contratación para excluir de los procedimientos a los oferentes coludidos, y la que tenían las autoridades de competencia para sancionarlos a posteriori no era idónea para impedir los efectos del acuerdo colusorio. Se describen las prácticas colusorias típicas, las limitaciones del Derecho español para prevenirlas y los avances contenidos en la Ley vigente.
