Abstract
Pekerja merupakan aset perusahaan yang berpengaruh di dalam menjalankan proses bisnisnya. Pekerja lebih lemah posisinya dibandingkan pemberi kerja. Sesuai perjanjian ketenagakerjaan terbagi menjadi dua jenis, yaitu Perjanjian Kerja Waktu Tertentu (PKWT) dan Perjanjian Kerja Waktu Tidak Tertentu (PKWTT). Dalam pelaksanaannya untuk penerapan PKWT yang dilaksanakan oleh perusahaan ada yang kurang sesuai dengan ketentuan perjanjian kerja yang diatur dalam Undang-Undang Ketenagakerjaan, sehingga aturan mengenai ketenagakerjaan masih terkendala dan menimbulkan permasalahan serta tantangan yang harus dihadapi dan memerlukan penyelesaian melalui pengadilan. Penulis bertujuan untuk mengetahui bentuk perlindungan hukum pekerja PKWT di Divisi Operasional Pemeliharaan Jalan Tol (OPJT) PT. Hutama Karya (Persero). Penelitian ini menggunakan jenis penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan, adapun sumber hukum yang digunakan baik primer maupun sekunder diperoleh melalui studi pustaka. Hasil penelitian ini menunjukkan bahwa Divisi OPJT PT. Hutama Karya (Persero) sudah menerapkan perjanjian kontrak kerja PKWT sesuai dengan ketentuan regulasi terkait ketenagakerjaan UU Ciptaker termasuk untuk perubahan kontrak dari PKWT ke PKWTT serta perubahan perjanjian kontrak PKWT menjadi karyawan tetap.
