ASPECTOS DO ACESSO À JUSTIÇA NO ESTADO DEMOCRÁTICO DE DIREITO

Abstract
O presente artigo trata do acesso à justiça no âmbito de um Estado Democrático de Direito, em virtude deste modelo estatal apresentar como cerne a dignidade da pessoa humana, com a prevalência da legalidade e da soberania popular, de modo que para que se configure os direitos fundamentais de todos e qualquer indivíduo devem estar positivados e assegurados de forma efetiva. Neste diapasão, o acesso à justiça se caracteriza como um direito essencial do indivíduo, que garante a efetivação de todos os demais direitos, de forma que quando inobservado, viola os preceitos inerentes de um Estado Democrático de Direito. Assim, a garantia dos direitos fundamentais não se restringe a positivação destes direitos e mero acesso ao Judiciário, mas envolve a resolução adequada de disputas de forma oportuna e justa, com a garantia dos direitos constitucionais. Diante disso, o artigo também examina o esforço legislativo pela busca da concretização deste direito para a população brasileira, a fim de que seja possível caracterizar o Brasil como um efetivo Estado Democrático de Direito, o que ainda se encontra em processo com significativos obstáculos.
