Abstract

Cet article étudie deux essais publiés à l’occasion du dixième anniversaire de l’affaire Noir Canada. Il s’agit d’identifier dans Le droit du plus fort d’Anne-Marie Voisard et Procès verbal de Valérie Lefebvre-Faucher les effets de l’intrication du droit et de l’économie sur le monde du livre et sur la liberté d’expression. Nous explorerons l’hypothèse qu’en analysant ces deux essais, qui examinent la poursuite bâillon qui a censuré la maison d’édition Écosociété, nous pouvons voir à l’oeuvre une modalité spécifique de l’économie, soit sa manifestation dans l’appareil juridique. Le jeu des intérêts, des transactions et des négociations mis au jour dans ces deux essais trace un imaginaire économique du droit qui est aussi une réflexion sur le pouvoir et ses méthodes de répression. Cet article se propose de rendre compte de l’émergence de l’analyse économique du droit et de la subordination de l’ordre juridique à la sphère économique. Nous soumettons l’hypothèse que le « droit-économie » – c’est-à-dire le droit en ce qu’il se fait la voix et la force de mise en oeuvre des principes économiques – se définit précisément contre la littérature. Nous cherchons également à comprendre ce que le droit-économie fait aux notions de fiction et de langage. Nous tentons finalement de comprendre comment la figuration du métier d’éditrice dans ces livres constitue à la fois une répétition et une actualisation d’une longue histoire de procès littéraires et de censure.
