Abstract
L’auteur offre une synthèse critique de l’évolution du contentieux administratif en droit canadien au cours de quarante dernières années et il s’interroge sur les facteurs susceptibles d’en changer la teneur à l’avenir. Il identifie les avancées qui lui paraissent avoir été les plus importantes et les plus fécondes à la fin du XXe siècle, dont l’émergence du pluralisme interprétatif, et il soutient que l’apport tout à fait innovateur d’un grand arrêt de la Cour suprême du Canada en 1978 n’a pas été exploité par les juristes autant qu’il méritait de l’être. Cela explique, selon lui, le développement par moment chaotique de la jurisprudence en matière de contrôle judiciaire. Il examine ensuite les tendances sociétales actuelles qui transforment la nature de l’action gouvernementale, ainsi que les réaménagements récents, institutionnels et autres, en droit public canadien et plus spécifiquement québécois.
