Abstract
This chapter examines a constitutional conflict that arose in Newfoundland in 1838 and ultimately reached the Judicial Committee of the Privy Council. It concerned the extent of a colonial assembly&s;s jurisdiction to use its contempt powers to protect its privileges against the Crown-appointed Supreme Court. The Newfoundland assembly, steeped in Irish political conflict, threatened legal order and raised the possibility that certain predispositions founded in ethnicity, religion or race might render a population incapable of self-government. Raising difficult questions of individual liberty, legal inheritance and parliamentary theory and unfolding at the same time as a structurally similar conflict that enveloped the House of Commons and the Court of King&s;s Bench, the case, Kielley v. Carson, became the occasion for reining in the powers of colonial legislatures.
