L’État défaillant au regard des exigences relatives à l’État de droit en droit international

Abstract
Dans la présente étude, il est soutenu que l’existence de certaines exigences minimales de l’État de droit caractérise tout « État normal ». Ce sens restrictif de l’État de droit repose sur la capacité de tout « État normal » à prévenir et à punir les violations graves du droit objectif, notamment à prévenir les crimes de masse et à en assurer la répression en cas de violation grave. Il est donc question de l’effectivité de l’ordre juridique de l’État. En ce sens, Kelsen comme Kant assimilaient déjà l’État au droit, à un ordre de contrainte. Les États dans lesquels l’anarchie règne à la place du droit sont ainsi considérés comme des États défaillants, ce qui nécessiterait une réponse adaptée de la communauté internationale. Cette approche de l’État défaillant a le mérite de recentrer le débat y afférent sur la question de l’effectivité non plus du gouvernement, mais sur celle du droit, même si les deux sont liés.
