Abstract
Berdasarkan amanat Undang - Undang Dasar Negara Republik Indonesia Tahun 1945, Pemerintahan Daerah mempunyai kewenangan untuk mengurus sendiri urusan pemerintahan menurut asas otonomi dan tugas pembantuan. Otonomi daerah menggunakan prinsip otonomi seluas luasnya. Ini berarti bahwa DPRD memiliki hak inisiatif yaitu hak untuk mengajukan rancangan peraturan daerah. Dewan Perwakilan Rakyat Daerah yang selanjutnya disingkat DPRD adalah lembaga perwakilan rakyat yang berkedudukan sebagai unsur penyelenggara pemerintahan daerah, sebagaimana yang tercantum dalam UU No. 23 tahun 2014 yang menyatakan bahwa: Pemerintahan daerah adalah penyelenggara urusan pemerintahan oleh pemerintah daerah dan DPRD menurut azas otonomi dan tugas pembantuan dengan prinsip otonomi seluas - luasnya dalam sistem dan prinsip Negara Kesatuan Republik Indonesia. Dalam menjalankan tugas sebagai anggota dewan, dituntut memiliki kualitas yang baik untuk dapat menunjang berjalannya suatu pemerintahan, dengan hak - hak yang dimiliki serta fungsi - fungsi yang diembankan kepada mereka, maka sepatutnya kualifikasi seorang anggota harus berkualitas baik. Sejauh ini dari beberapa fenomena, banyak anggota dewan yang tidak mengetahui apa yang harus dilakukan sebagai anggota dewan. Penelitian ini mencoba mengkaji mengenai pelaksanaan hak inisiatif anggota dewan dalam pembuatan peraturan daerah di Kabupaten Toba Samosir terutama dalam peningkatan pendidikan non formal. Penelitian ini menggunakan metode penelitian kualitatif. Dari hasil penelitian dapat disimpulkan bahwa pelaksanaan hak inisiatif anggota dewan DPRD Toba Samosir periode 2014-2019 belum berjalan secara efektif
