En droit privé comme en droit public, l’histoire et la théorie enseignent que le concept juridique du conflit d’intérêts est intimement lié au pouvoir dont dispose la personne. Afin de prévenir le risque de conflit d’intérêts dans l’exercice d’un pouvoir, le droit peut prendre deux voies : soit il interdit formellement de s’engager dans certains actes (comme la prohibition faite à l’élu municipal du Québec de contracter avec sa municipalité), ou, plus fréquemment, il lui impose simplement une règle de transparence : soit la divulgation-abstention. C’est l’avenue choisie tant par le Québec que la France pour l’élu municipal qui s’engage auprès d’un promoteur éolien à accueillir contre rémunération une éolienne sur sa terre. Dans les deux cas, la municipalité joue pourtant un rôle déterminant pour décider du sort d’un projet éolien. Des différences importantes marquent toutefois l’application de la règle. Surtout, la France présente une palette plus large de sanctions souvent plus sévères pour l’élu qui contrevient à la règle de la transparence.
