Abstract
En droit québécois, le pouvoir de déclarer une personne coupable d’outrage au tribunal se justifie par l’impératif d’assurer une saine administration de la justice et de sauvegarder l’autorité des tribunaux. Les juges québécois demeurent sensibles au droit pour toute personne de manifester son opinion même controversée ou impopulaire. Les tribunaux auraient tendance à considérer les couvertures médiatiques d’envergure comme appuyant l’apparence de droit au maintien du statu quo. Si un juge ne peut à la limite être complètement impartial, prendre conscience de ses préjugés est un pas dans la bonne direction.
