Abstract
La singularité des enregistrements des archives audiovisuelles de la justice de certains procès lui confère une place à part par rapport aux autres archives dans le Code du patrimoine. Son histoire particulière et son statut juridique expliquent ses spécificités. Issues de la volonté de Robert Badinter, Garde des Sceaux, ministre de la Justice, la caméra entre dans les prétoires pour constituer la mémoire de la justice à travers des archives historiques vidéo ou sonores, intégrales, sans coupures, sans ajouts, sans montage. Quand la loi du 11 juillet 1985 est adoptée, elle rompt l’interdiction de filmer ou de photographier les procès, qui remonte à 1954. Depuis, 28 procès ont été enregistrés : crimes commis pendant la Seconde Guerre mondiale, crimes contre l’humanité, crimes de génocide contre les Tutsi au Rwanda, crimes des attentats terroristes. Les sujets historiques caractérisent leur captation. Accéder à ces archives, pouvoir les consulter constitue un enjeu social, pédagogique et de mémoire.
