La disparition récente de Jacques-Yvan Morin prête à revisiter son oeuvre. Le présent texte propose quelques réflexions fort modestes à propos d’un des éléments sur lesquels il s’était brillamment penché, soit le principe de souveraineté parlementaire et la façon dont il se conjugue avec la protection des droits et libertés de la personne. On observe une modification dans la façon dont ce principe est mis en oeuvre récemment, ce qui compromet la possibilité du dialogue entre les pouvoirs et, par conséquent, le débat public qui, en l’absence d’une décision judiciaire, risquerait de ne pas avoir lieu. Le legs intellectuel et démocratique du professeur Morin, qui s’incarne notamment dans la Charte des droits et libertés de la personne dont le Québec s’est doté, se trouve de ce fait en péril.
