En juillet 2022, la décision de la Cour du Québec d’accorder une absolution conditionnelle dans un dossier d’agression sexuelle fait la manchette (R. c. Houle, 2022 QCCQ 4039). Des articles dénoncent cette peine (Hachey, 2022), alors que d’autres la défendent et s’inquiètent que les critiques nuisent à l’indépendance de l’appareil judiciaire (Thériault, 2022). À l’instar d’Ehrlich (2001) qui s’intéresse aux dynamiques discursives qui occurrent dans les procès en matière d’agression sexuelle, dans le cadre de cet article, je propose une analyse discursive du jugement R. c. Houle (2022 QCCQ 4039). J’accorderai une attention particulière à l’agentivité (Fillmore, 1967) lorsqu’elle est combinée à divers axiologiques (Kerbrat-Orecchioni, 2009). Puisque la peine a depuis été modifiée, je m’attarderai sur les conclusions du deuxième jugement (R. c. Houle, 2023 QCCA 99) afin de voir s’il est possible de tisser des liens entre les éléments linguistiques relevés dans mon analyse et les motifs derrière l’appel.
