Abstract
On 1 January 2016, a new code of civil procedure came into force in Québec. Apart from the traditional rules on state procedure, this code contains provisions regarding alternative dispute resolution methods. In addition to arbitration, which is already well known under Québec law, it addresses conventional mediation. In order to express its will to promote these methods of dispute resolution, the legislator chose to begin the code with the governing principles, placing them immediately after a “preliminary provision”. The importance of referring to and promoting these non-judicial proceedings is put in concrete terms in the third paragraph of the first article. Unfortunately, the wording of the provision is ambiguous, not to say incoherent. It is necessary to systematically and meticulously analyse the guiding principles of the code to discover its meaning. In the end, the third paragraph of the first article may only be a figure of speech.
