Abstract
This chapter discusses the legal tests and procedures that must be met to admit expert bloodstain pattern analysis (BPA) evidence in courtrooms in the United States and Canada. Practical matters included in this discussion are expert qualifications, the qualification voir dire , drafting expert reports, and the importance of peer review. The use of BPA evidence in court is not without controversy and for this reason case law is presented and analyzed on key legal topics such as threshold legal challenges to the validity and reliability of BPA evidence ( Daubert/Frye ) as well as legal challenges to various aspects of BPA evidence generally and the experts who present it in court. The importance of visualizing complex forensic evidence to educate the trier of fact is introduced along with suggestions for how to achieve that pedagogical objective. The chapter concludes with recommendations for the effective presentation of BPA evidence in court.
