Abstract
Le présent numéro des Cahiers de droit sur le temps et le droit constitue l’occasion rêvée de relever un nouveau défi, soit saisir temporellement le droit et, plus particulièrement, le droit de la gouvernance. Deux temps sont explorés dans le texte qui suit : la rétroaction et la réflexivité. Pour ce faire, deux des plus célèbres théories relatives au temps sont momentanément mobilisées, soit la théorie de la relativité et la théorie de l’évolution. Si la rétroaction fait intrinsèquement partie du jugement juridique, sa théorisation relève davantage du paradigme de la régulation propre à la gouvernance. Quant à la réflexivité, même si son émergence en théorie du droit est plus récente, elle s’avère néanmoins tout aussi indispensable pour penser l’application effective du droit. Malgré des généalogies différentes, la rétroaction et la réflexivité s’inscrivent toutes les deux dans une conception pragmatiste du droit, plus précisément du droit de la gouvernance.
