Abstract
Trente ans après l’arrêt Domtar, les principes qui y ont été établis par la Cour suprême du Canada en matière de controverses jurisprudentielles au sein de l’Administration ont survécu aux diverses réformes du contrôle judiciaire, dont celle opérée par l’arrêt Vavilov. En utilisant l’exemple de décisions rendues à la suite de de○mandes d’accès à l’information, l’auteur suggère que le cadre normatif applicable à ces controverses présente certaines lacunes. Néanmoins, plutôt que de revenir sur les enseignements de l’arrêt Domtar, il propose de poursuivre sur la voie tracée par cet arrêt, à savoir la reconnaissance de l’autonomie décisionnelle de l’Administration.
