Abstract
Trata-se de estudo de caso de um “Círculo de Sentença” realizado em Ação Civil Pública impetrada na Vara da Infância de Ilhéus por conduto da Defensoria Pública do Estado da Bahia para implementação do ensino inclusivo pela rede pública municipal. O presente artigo visa proceder uma breve análise acerca do desafio enfrentado pelo julgador nas decisões que impliquem em políticas públicas, especialmente quando os destinatários são crianças e adolescentes com deficiência, decorrendo a importância da construção coletiva desses planos. Além disso, traz a discussão da viabilidade da justiça restaurativa como um modelo de intervenção para uma decisão judicial que agregue o saber coletivo. A abordagem é qualitativa com análise de dados primários por meio de observação participante da experiência inovadora do Círculo de Sentença, realizado pela primeira vez no Brasil, quiça no mundo, num processo de ação civil pública, resultando na implementação de uma verdadeira política pública municipal de inclusão de crianças e adolescentes com deficiência, pensada e estruturada de forma dialogada, multidisciplinar e plurissetorial.
